Is the consent of one and the other parent required for the issuance of a passport for a minor? How can this action be performed?
- The consent of the person’s mother and father is required for the issuance of a passport document to a person who lacks legal capacity or has limited legal capacity and is under 18 years of age.
- Consent is not required of a mother or father who has been deprived of parental authority or whose parental authority has been suspended or limited in terms of consenting to the issuance of a passport document. In that case, a document specifying the scope of parental authority shall be submitted with the application for a passport document.
- Consent shall be given:
- in person at the passport authority at the time of application for a passport document
- in writing recorded in paper form, bearing a signature certified by the passport authority or a notary public;
- in writing recorded in electronic form, bearing a qualified electronic signature, trusted signature or personal signature.
- If the positions of the mother and father are incompatible, or it is impossible to obtain the consent of one of them, the consent for the issuance of a passport document shall be replaced by a family court decision, which shall be submitted with the application for the issuance of a passport document.
- The consent of the mother or father to the issuance of a passport document and the decision of the family court shall be the basis for the issuance of a single passport document.
