Issuance of new documents (for beneficiaries of the Exit Agreement who do not have a document of a foreign EU citizen/family member of a foreign EU citizen, but were in Poland before 2021)

Registration of residence

You apply for a certificate of residence registration if you are a citizen of the OC/Beneficiary of the Wystąpienie Agreement, you do not have a document of residence registration, but you were in Poland before 31.12.2020 and you continue your stay that lasts more than 3 months and less than 5 years.

You can submit your application from 1.01.2021.

In the case of a foreigner who is a minor, the application is submitted by parents or court-appointed guardians, or one of the parents or one of the court-appointed guardians.

Documents needed:

  • application in 1 copy, completed in accordance with the instructions,
  • photocopy of a valid travel document or other document proving identity and citizenship (original for inspection)
  • 4 photographs
  • Your written statement (signed) of your continued residence in Poland after December 31, 2020, indicating absences of more than 6 months in the 12 months preceding the submission of the application, or other proof that you were residing in Poland on or before December 31, 2020 (e.g., confirmation of your registration, employment contract, apartment lease agreement, electricity bill, internet service contract, telephone service contract, evidence of recent entry to Poland like tickets, etc.).

If you are working or planning to work:

  • employment contract, certificate of work performance, written statement of the employer or entity authorized to entrust work performance on the intention to entrust work performance (applies to planned work performance) issued not earlier than one month before the date of application

If you are engaged in gainful self-employment:

  • a written statement regarding entry in the National Court Register or the Central Register and Information on Business Activity, or other proof that you are self-employed in the territory of the Republic of Poland;

If you are studying or undergoing vocational training:

  • a certificate from the unit conducting your studies that you are enrolled in a course of study or that you are continuing your studies, or a certificate from the unit conducting your vocational training that you are enrolled in such training, issued no earlier than one month before the date of your application,
  • a document confirming health insurance coverage,
  • a written statement that you have sufficient financial resources to support yourself and family members, or proof of their possession.

If you are the spouse of a Polish citizen:

  • a document confirming your marriage to a Polish citizen (a current copy of the marriage certificate issued no later than 3 months before the date of application),
  • a photocopy of the spouse’s identity document (ID card or passport) – the original must be presented for inspection or attached notarized;

In other cases:

  • proof of sufficient financial resources to support yourself and family members;
  • document confirming health insurance coverage

In case a family member who is also a citizen of the OC resides or joins a citizen of the OC:

  • a copy of the residence registration certificate issued to the ZK citizen with whom the family member resides in the territory of the Republic of Poland,
  • spouse – document confirming marriage (e.g., marriage certificate),
  • descendant – a document confirming the existence of family ties and a document confirming age or certifying dependency of the citizen of the OC or his spouse (e.g. birth certificate),
  • ascendant – a document confirming the existence of family ties and a document certifying dependency of a citizen of the OC or his spouse

Permanent residence

You apply for a document confirming the right of permanent residence if you are a citizen of the OC/beneficiary of the Exit Agreement, you do not have a document confirming the right of permanent residence, but you have stayed in Poland until 31.12.2020 and you continue your stay, which lasts continuously for 5 years or more.

In the case of a foreigner who is a minor, the application is submitted by the parents or court-appointed guardians, or by one of the parents or one of the court-appointed guardians.

Documents needed:

  • application in 1 copy, completed in accordance with the instructions.
  • photocopy of a valid travel document or other document proving identity and citizenship (original for inspection)
  • 4 photographs,
  • documents confirming 5 years of uninterrupted stay in the territory of the Republic of Poland,
  • documents stating the reasons for interruptions in residence, if any.

Residence card of a family member of a citizen of the OC

You apply for a residence card if you are a family member of a ZK citizen and you do not have a residence card of a family member of an EU citizen, but you stayed in Poland until 31.12.2020 and continue your stay, which lasts more than 3 months and less than 5 years.

In the case of a foreigner who is a minor, the application is submitted by parents or court-appointed guardians, or one of the parents or one of the court-appointed guardians.

Documents needed:

  • application in 1 copy, completed in accordance with the instructions.
  • photocopy of a valid travel document or other document proving identity and citizenship (original for inspection)
  • 4 photographs,
  • spouse – document confirming marriage (e.g. marriage certificate),

  • a copy of a certificate of registration of residence, issued to the citizen of the OC with whom you reside in the territory of the Republic of Poland

Permanent residence card of a family member of a ZK citizen

You apply for a permanent residence card of a family member of a ZK citizen if you are a family member of a ZK citizen and you do not have a permanent residence card of a family member of an EU citizen, but you stayed in Poland until 31.12.2020 and you continue your stay, which lasts continuously for 5 years or more.

Documents needed:

  • application in 1 copy, completed in accordance with the instructions,
  • photocopy of a valid travel document or other document confirming identity and citizenship (original for inspection)
  • 4 photographs,
  • documents confirming 5 years of uninterrupted stay in the territory of the Republic of Poland,
  • documents stating the reasons for interruptions in residence, if any.
Citizens of the OC who are not beneficiaries of the Exit Agreement (were not in Poland before 2021)

The general rules of entry and stay in the territory of Poland relating to third-country nationals will apply to citizens of the UK and their family members who are not beneficiaries of the Withdrawal Agreement after the transition period (i.e., who were not in Poland before 2021).
