Permanent residence permit
Documents needed to obtain a stamp in a passport (so-called formal requirements) for all proceedings regardless of the circumstances of residency:
- Completed application for permanent residence (download) copy of the completed application
- 4 biometric photographs – not older than 6 months,
- Photocopy of the saved pages of a valid travel document (original for inspection). In a particularly justified case, if you do not have a valid travel document and do not have the opportunity to obtain one, you can provide another document to prove your identity.
- presentation of a confirmation of payment of stamp duty for the issuance of a permit PLN 640.
Possession of Polish ancestry
A permanent residence permit on the basis of Polish ancestry is granted to a person whose at least one parent or grandparent or two great-grandparents are of Polish nationality and who declares Polish nationality and demonstrates their connection with Polishness.
Documents needed for granting the permit:
- documents confirming the Polish nationality of your ancestors,
- documents confirming your desire to settle on the territory of the Republic of Poland (e.g., lease agreement, employment contract, documents confirming studies, etc.).
- additional documents: documents indicating your connection to Polish nationality, e.g. certificates of membership in Polish organizations
Possession of a Pole’s Card
A permanent residence permit is granted to a person who holds a Pole’s Card and wishes to settle in Poland permanently.
Documents needed to grant the permit:
- a copy of the Pole’s Card with the original for inspection,
- statement of intent to settle in Poland permanently on the form.
- documents confirming your intention to settle in the territory of the Republic of Poland (e.g. lease agreement, employment contract, documents confirming studies, etc.).
There is no stamp duty for an application for a permanent residence permit on the basis of a Pole’s Card.
Spouse of a Polish citizen
A permanent residence permit for the spouse of a Polish citizen is granted to a person who has been continuously residing on the territory of Poland for a period of not less than 2 years on the basis of a temporary residence permit granted in connection with being married to that Polish citizen and at least 3 years have passed since the marriage.
Documents needed for granting the permit:
- a copy of the marriage certificate, registered at the Polish Registry Office
- a written statement of Polish citizenship, completed by the spouse/s of the party to the proceedings.
You submit all documents in original/certified copy.
A minor child of a citizen of the Republic of Poland
A permanent residence permit for a minor is granted to a child of a Polish citizen under his/her parental authority. The application on behalf of a foreign minor is submitted by the parents or court-appointed guardians, or by one of the parents or one of the court-appointed guardians. When submitting the application of a minor who has reached the age of 6, his presence is required.
Documents needed for granting the permit:
- child’s birth certificate,
- written statement of Polish citizenship, completed by the parent of the minor, or a copy of the parent’s identity card.
Minor child of a foreigner
You apply for a permanent residence permit if you are a foreigner who has been granted a permanent residence permit or an EU long-term resident permit and you want to obtain a permanent residence permit for your minor children who were born:
- after you were granted a permanent residence permit or an EU long-term resident permit, or
- during the period of validity of a temporary residence permit granted to you, or during the period of a humanitarian or tolerated stay permit granted to you, or in connection with the granting of refugee status or subsidiary protection to you
Documents needed for granting the permit:
- child’s birth certificate,
- sworn translation of the birth certificate (in case the birth certificate was issued outside Poland)
- a copy of the parent’s decision to grant a residence permit in Poland
Possession of a tolerated stay permit in Poland
A permanent residence permit is granted to a person who has been continuously residing on the territory of Poland for not less than 10 years, on the basis of a tolerated stay permit.
A permanent residence permit may not be granted to foreigners who have been granted a permit for tolerated stay in the territory of Poland due to the unenforceability of the foreigner’s obligation to return for reasons beyond the control of the authority competent to enforce the decision on the foreigner’s obligation to return and the foreigner (i.e., the permit for tolerated stay was issued on the basis of Article 351(1)(2) of the Law on Foreigners).
Documents needed to grant the permit:
- decision on granting a permit for tolerated stay,
- documents confirming that your stay in Poland was uninterrupted or documents stating the reasons for any breaks in your stay.
Having refugee status or subsidiary protection in Poland or a residence permit for humanitarian reasons
A permanent residence permit is granted to a person who has been continuously residing in the territory of Poland for a period of not less than 5 years after being granted refugee status, subsidiary protection or a permit for humanitarian reasons.
You apply for a permanent residence permit in person, after the expiration of 5 years from the granting of refugee status, subsidiary protection or consent for humanitarian reasons.
Documents needed for granting the permit:
- a decision confirming that you have refugee status, subsidiary protection or humanitarian residence,
- documents confirming that your stay in the territory of Poland was uninterrupted or documents stating the reasons for breaks in your stay.
Being a victim of human trafficking
A permanent residence permit is granted to a person who has held a temporary residence permit for a victim of human trafficking for at least 1 year and has cooperated with law enforcement and has a well-founded fear of returning to their country of origin.
Documents needed for granting the permit:
- documents proving that you have cooperated with law enforcement and have a well-founded fear of returning to your country of origin,
- a copy of the decision for temporary residence for a victim of human trafficking.
Receiving asylum in Poland
A permanent residence permit is granted to a person who has been granted asylum on the territory of the Republic of Poland. You can apply immediately after receiving the decision of the Head of the Office for Foreigners to grant you asylum in Poland.
Documents needed to grant the permit:
- decision of the Head of the Office for Foreigners on granting asylum in the territory of the Republic of Poland.
There is no stamp duty for an application for a permanent residence permit due to the granting of asylum in the territory of the Republic of Poland.
