Cancellation of one of two civil status records stating the same event
Conducting proceedings for the annulment of one of two civil status records stating the same event.
According to Article 39b of the Law of November 28, 2014. Law on Civil Status Records, if more than one civil status record stating the same event has been registered in the civil status register for reasons other than those specified in Article 39a (1) [for technical reasons or as a result of improper use of the functionality of the civil status register], and the circumstances indicated in each of these records do not raise any doubt that the subject of registration in each of them is the same event, the governor in charge of the head of the civil status office that registered the last record shall cancel the civil status record or records in the form of an administrative decision. The proceedings referred to in paragraph 1 are initiated ex officio or at the request of the person to whom the record pertains, a person with a legal interest therein, or a public prosecutor.
Pursuant to Article 127 of the aforementioned law, if more than one civil status record stating the same event, made before the date of entry into force of this law or made pursuant to Article 145, is transferred to the civil status register, and the circumstances indicated in each of these records raise no doubt that the subject of the registration in each of them is the same event, the governor in charge of the head of the civil status office who made the last record shall cancel the record or records in the form of an administrative decision.
If the registration of civil status in the form of a civil status record occurred after the date of entry into force of this Law and a civil status record stating the same event, which was prepared before the date of entry into force of this Law or prepared under Article 145, was transferred to the civil status record, and the circumstances indicated in each of these records do not raise any doubt that the subject of the registration in each of them is the same event, the governor competent for the head of the civil status office that prepared the last record shall cancel the civil status record or records in the form of an administrative decision.
Proceedings for the cancellation of a civil status record are initiated ex officio or at the request of the person to whom the record relates, a person with a legal interest in the record, or a public prosecutor.
